Full Journal pdf2003-02-12 House Journal Page 0189 HB 69 The following, which was advanced to third reading from the February 10, 2003, calendar (page 170), was read the third time: 2003-02-12 House Journal Page 0190 HOUSE BILL NO. 69 "An Act relating to regulation of shallow natural gas leasing and closely related energy projects; and providing for an effective date." Representative Kerttula moved and asked unanimous consent that HB 69 be returned to second reading for the specific purpose of considering Amendment No. 1. Objection was heard. Representative Kerttula moved and asked unanimous consent to withdraw her motion. There being no objection, it was so ordered. Amendment No. 1 and Amendment No. 2 were not offered. Representative Croft moved and asked unanimous consent that HB 69 be returned to second reading for the specific purpose of considering Amendment No. 3. There being no objection, it was so ordered. Amendment No. 3 was offered by Representative Croft: Page 1, line 4, following "*Section 1.": Insert "The uncodified law of the State of Alaska is amended by adding a new section to read: LEGISLATIVE INTENT. It is the intent of the legislature that (1) The Alaska Oil and Gas Conservation Commission adopt regulations that address the oversight, under AS 31.05, of shallow natural gas or coal bed methane exploration and development activities on leases authorized by AS 38.05.177 or by other law; the commissions' regulations must be reasonable and appropriate to the recovery of the gas described in AS 38.05.177(a); and (2) the provisions of sec. 3 of this Act apply to allow for a temporary accommodation for the treatment of shallow natural gas exploration and development activities during the time necessary to propose and adopt those regulations. * Sec. 2. AS 31.05.030(f) is amended to read: (f) The commission (1) shall adopt regulations to oversee shallow natural gas exploration and development activities; the 2003-02-12 House Journal Page 0191 regulations must be reasonable and appropriate to the recovery of the gas described in AS 38.05.177; and (2) may classify wells as oil or gas wells for purposes material to the interpretation or enforcement of this chapter. * Sec. 3" Representative Croft moved and asked unanimous consent that Amendment No. 3 be adopted. Representative Kohring objected.
